Since the failed 1994 referendum, all parties have agreed that new constitutions need to be approved by referendum. Albania's 1976 socialist constitution was declared invalid in April 1991, and an interim basic law was adopted. The country remains without a permanent constitution; a draft constitution was rejected in a November 1994 referendum.

A constitutional referendum was held in Albania on 22 November 1998. Voters were asked whether they approved of the constitution.It was approved by 93.5% of voters with a turnout of 50.6%, and came into force on 28 November.
